1. 招标文件的编制依据与构成 Compilation Principle and Contents of Bidding Documents
1.1 本招标文件的编制依据是《中华人民共和国招标投标法》和中华人民共和国商务部令2004年第13号《机电产品国际招标投标实施办法》。
The bidding document is compiled based on The Bidding Law of the People’s Republic of China and the Implementation Measures for International Competitive Bidding for Mechanical and Electrical Products (Order No.13 [2004] of the Ministry of Commerce) of the People’s Republic of China.
1.2 要求提供的货物、招标过程和合同条件在招标文件中均有说明。招标文件以中文或中、英文两种文字编写。以中、英文两种文字编写时，两种文字具有同等效力；中文本与英文本如有差异，以中文本为准。
The goods required, bidding procedures and contract terms are prescribed in the bidding documents. The bidding document is written either by Chinese or by Chinese and English. In the case of Chinese and English, two languages have the same effectiveness. In the event of any discrepancies between them, the Chinese version shall govern.
招标文件共八章，分装两册。
The contents of the bidding documents will be separated into two volumes.
1.3 投标人应认真阅读招标文件中所有的事项、格式、条款和技术规格等。投标人没有按照招标文件要求提交全部资料，或者投标没有对招标文件在各方面都作出实质性响应是投标人的风险，并可能导致其投标被拒绝。
The Bidder is expected to examine all instructions, forms, terms and specifications in the bidding documents. Failure to provide all information required by the bidding documents or to submit a bid not substantially responsive to the bidding documents in every respect will be at the Bidder’s risk and may result in the rejection of its bid.
2. 招标文件的澄清 Clarification of Bidding Documents
2.1 任何要求对招标文件进行澄清的潜在投标人，均应以书面形式通知招标机构和招标人。招标机构对其在投标资料表中所述投标截止期5日以前收到的对招标文件的澄清要求均以书面形式予以答复，同时将书面答复发给每个购买招标文件的潜在投标人(答复中不包括问题的来源)。
A prospective Bidder requiring any clarification of the bidding documents may notify the Tendering Agent and the Tenderee in writing. The Tendering Agent shall respond in writing to any request for clarification of the bidding documents which it receives no later than five (5) days prior to the deadline for the submission of bids prescribed in the Bid Data Sheet. Written copies of the Tendering Agent’s response (without identifying the source of inquiry) will be sent to all prospective bidders who have purchased the bidding documents.
2.2 投标人认为招标文件存在歧视性条款或不合理要求，应在规定时间内一次性全部提出。
If the Bidder regards any discrimination clause or unreasonable requirement in the bidding documents, he shall submit once and for all in the stipulated time.
3. 招标文件的修改 Amendment of Bidding Documents
3.1 在投标截止期前，无论出于何种原因，招标机构和招标人可主动地或在解答潜在投标人提出的澄清问题时对招标文件进行修改。
Prior to the deadline for the submission of bids, the Tendering Agent and the Tenderee, for any reason, whether at their own initiative or in response to the clarification requested by a prospective Bidder, may modify the bidding documents.
3.2 招标文件的修改是招标文件的组成部分，将以书面形式通知所有购买招标文件的潜在投标人，并对潜在投标人具有约束力。潜在投标人在收到上述通知后，应立即以书面形式向招标机构和招标人确认。
The amendment of the bidding documents is an integral part of the bidding documents and all prospective bidders who have purchased the bidding documents will be notified of the amendment in writing, which will be binding on them. The prospective Bidders shall promptly acknowledge the receipt thereof in writing to the Tendering Agent/the Tenderee.
3.3 为使投标人准备投标时有充分时间对招标文件的修改部分进行研究，招标机构和招标人将适当推迟投标截止期。
In order to afford prospective bidders reasonable time in which to take the amendment into account in preparing their bids, the Tendering Agent and the Tenderee, at their discretion, will extend the deadline for the submission of bids.
