承包商的职责

Contractor’s Responsibilities

1. 承包商应负责设计、筹划以及在工地上建造工厂。

The Contractor shall be responsible for the design, planning and construction of the plant at the site.

2. 除了业主根据第XXX条提供的项目和设施，承包商应提供所有为使工厂成功建造所必需的设备、材料、工具、设施、劳工和服务。

The Contractor shall provide all equipment, materials, tools, facilities, labor and services necessary for the successful construction of the plant except those items and facilities to be supplied by the Owner under Article XXX.

3. 承包商应根据附录XXX中的日程安排施工。

The Contractor shall perform the works in accordance with the schedule in Appendix XXX.

4. 承包商应根据附录XXX中的规定为业主培训工厂设备的操作和维修人员。

The Contractor shall train the personnel of the Owner for the operation and maintenance of the plant equipment according to the provisions in Appendix XXX.

5. 承包商应向业主提供附录XXX中规定的备件。

The Contractor shall provide the Owner with the spare parts specified in Appendix XXX.

6. 承包商应向业主提供附录XXX中指定的维修设备。

The Contractor shall provide the Owner with the maintenance equipment specified in Appendix XXX.

业主的职责

Owner’s Responsibilities

1. 业主应提供工地，并在本合同有效期内允许承包商自由地、不受干扰地出入该工地。

The Owner shall make available the site and grant the Contractor free and uninterrupted access to the Site during the validity of this Contract.

2. 业主应按时提供附录XXX中指定的物件和设施。

The Owner shall provide the items and facilities specified in Appendix XXX at the time therein established.

3. 业主将从有关部门获取为工厂建造、设备运行所必需的执照和许可证，包括承包商雇员的工作许可证。

The Owner will obtain those licenses and permits necessary for the construction of the plant and operation of the equipment from the relevant authorities, including the work permit for the Contractor’s employees.

4. 业主应按第XXX条中规定的合同价格向承包商支付工程款项。

The Owner shall pay the contractor for the works at the contract price specified in Article XXX.
